Welcome to Install Now's Terms & Conditions. By accessing and using our website and services, you agree to comply with and be bound by the following terms and conditions. If you do not agree with these terms, please do not use our services.
1. Use of Services
1.1 You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are of legal age to form a binding contract.
1.2 You agree to use our services only for lawful purposes and in accordance with applicable laws and regulations.
2. Service Provision
2.1 Our services include appliance and TV installation, as well as related services such as removal of old appliances if bought separately.
2.2 We strive to provide accurate information and descriptions on our website, but we do not warrant that the information is complete, accurate, or current.
3. Payment and Pricing
3.1 Payment for our services is due upon completion of the installation.
3.2 Pricing for our services is subject to change without notice. The price at the time of booking will be honored for your scheduled service.
4. Intellectual Property
4.1 All content on our website, including text, graphics, logos, images, and software, is the property of Install Now and is protected by copyright and other intellectual property laws.
4.2 You may not use our intellectual property without our explicit permission.
5. Limitation of Liability
5.1 To the extent permitted by law, Install Now shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our services.
5.2 We are not responsible for any damages to your property that may occur during the installation process, unless caused by our negligence.
6. Class Action / Jury trial waiver
Please read the following provision carefully. By using Install Now's services, you agree to waive your right to obtain relief or damages as a member of a class or through a jury trial.
As used in this Class Action / Jury Trial Waiver provision, "You" and "Your" include you, your heirs, survivors, representatives, subsidiaries, affiliates, agents, employees, predecessors in interests, successors, and assigns.
In the event that you intend to commence a court proceeding, you must first notify Install Now by contacting our Customer Experience Center at sales@installnow.ca ("Notice") and attempt to resolve your claim. If you and Install Now do not reach an agreement to resolve your claim within 30 days after the Notice has been provided, either party may commence a court proceeding in accordance with this Agreement.
6.1 EXCEPT WHERE PROHIBITED BY LAW, you and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any class action lawsuit. You and we expressly waive any right you may have to bring or participate in a claim as a class, collective, or representative proceeding against Install Now and/or its affiliated entities.
6.2 EXCEPT WHERE PROHIBITED BY LAW, you and we agree to waive any right to a trial by jury for any claim.
If this Class Action/Jury Trial Waiver provision or any portion of this provision is held to be unlawful, void, or for any reason unenforceable, this provision (or portion of this provision), to the extent required, will be severed from this Agreement, but such severance will not affect the validity and enforceability of the remaining provisions of this Agreement.
7. Privacy
7.1 We collect, use, and protect personal information in accordance with our Privacy Policy. By using our services, you consent to the practices described in the Privacy Policy.
8. Termination
8.1 We reserve the right to terminate or suspend your access to our services at our sole discretion, without notice or liability, for any reason, including if we believe your use violates these terms.
9. Governing Law
9.1 These terms and conditions shall be governed by and construed in accordance with the laws of Canada. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Canada.
